VINS ET VIGNOBLES FAYARD publishes the www.chateausaintemarguerite.com website.

VINS ET VIGNOBLES FAYARD is a limited liability company with a capital of €10,000.00, registered in the Toulon Trade and Companies Register under no. 484 980 867, with its registered office at 381 Route de Valcros - 83250 LA LONDE LES MAURES.

1.2 The host

The website is hosted by Infomaniak.

Article 2 - Acceptance of the terms and conditions of sale

By placing an order on the www.chateausaintemarguerite.com website, the customer declares that he/she has read and accepted these terms and conditions of sale.

Article 3 - Products

3.1. Characteristic features

VINS ET VIGNOBLES FAYARD offers wine for sale.

The characteristics of the products are indicated on the website for each product so that the customer can be aware of them before placing an order.

3.2. Product photographs

VINS ET VIGNOBLES FAYARD will make its best efforts to ensure that the photographic representation of the products on the website is as faithful as possible to the products.

However, given the digital presentation of the products and their characteristics, the customer's perception of the graphic representation of the products may not correspond exactly to the product itself.

3.3. Alcohol

In accordance with article L. 3342-1 of the French Public Health Code, the sale of alcoholic beverages to minors under the age of eighteen (18) is prohibited.

The customer declares to be at least eighteen (18) years of age at the time of placing the order on the VINS ET VIGNOBLES FAYARD website.

The Customer certifies that he/she is of legal age by checking the box online when he/she arrives on the home page of the www.vinsfayard.com website and when placing an order.

VINS ET VIGNOBLES FAYARD reserves the right to cancel any order placed by a person under the age of 18.

ALCOHOL ABUSE IS DANGEROUS FOR YOUR HEALTH.

Article 4 - How to order

4.1 Registration

In order to place an order on the www.chateausaintemargueirte.com website, the customer must register by filling in the form provided online for this purpose, giving his or her full name, address and e-mail address.

The customer is solely responsible for choosing a login and password.

Login and password are strictly personal. Lending or transferring the username and password to any third party for any reason whatsoever is prohibited. Confidentiality of login and password is the full responsibility of the customer.

Once the customer has validated their registration, they can continue shopping at www.chateausaintemarguerite.com.

On subsequent visits, customers will be asked to enter their login and password to access their account. In addition to their contact details, they will have access to their order history and current orders.

Furthermore, the customer is expressly informed that in the event of non-payment of one of the orders, VINS ET VIGNOBLES FAYARD may suspend the customer's account or even delete it, as well as in the event of fraud, without prior notice.

4.2. Ordering process

The customer is expressly informed that the minimum quantity per order is six (6) bottles.

Once the delivery option has been selected, an order summary page appears, giving customers the opportunity to check their order and modify it if necessary.

After verification, the customer validates the order and pays the order amount.

Once the order has been paid for, VINS ET VIGNOBLES FAYARD immediately sends an e-mail to the address indicated by the customer when creating their account, containing a summary of the order (product, price and delivery date).

Article 5 - Financial conditions

5.1. Prices

Unless otherwise stated, the prices indicated on the www.chateausaintemarguerite.com website include value-added tax but exclude delivery charges.

The delivery charge is €15 per order.

Delivery is free for all orders over one hundred and eighty (180) € including VAT (excluding delivery costs).

For orders to Corsica, please contact the estate at 0494004444.

VINS ET VIGNOBLES FAYARD reserves the right to modify prices. The prices applicable are those in force at the time of the order.

Any discount or promotional offer is limited to one per household (same name and same address).

5.2. Payment methods

Customers may pay for their orders by credit card. Payment cards currently accepted are visa, mastercard and american express.

The communication by the customer of his credit card number is equivalent to authorization to debit his account up to the amount of the order.

The customer guarantees that he/she is fully authorized to use the payment card to pay for his/her order and that the means of payment provide access to sufficient funds to cover all costs related to the order.

The customer is expressly informed that VINS ET VIGNOBLES FAYARD may carry out checks to ensure the validity of payments and thus request certain supporting documents from the customer. By placing an order, the customer undertakes to provide the supporting documents requested within forty-eight (48) hours of VINS ET VIGNOBLES FAYARD's request.

In the event that VINS ET VIGNOBLES FAYARD does not receive the requested documents or does not receive them within the contractually agreed time period, VINS ET VIGNOBLES FAYARD reserves the right to cancel the order(s) and will inform the customer by e-mail.

5.3. Payment security

VINS ET VIGNOBLES FAYARD uses the SSL secure protocol to protect all data related to payment information and means of payment for payment by credit card for orders placed on the www.vinsfayard.com site.

VINS ET VIGNOBLES FAYARD does not store any banking information.

5.4. Invoice

The invoice will be sent on paper in the parcel.

The customer may, however, request an electronic copy of the invoice. This request must be made by e-mail to the following address: contact@vinsfayard.com, at least twenty-four (24) hours after the order has been placed.

Article 6 - Product availability

In the event of total or partial unavailability of the product(s) after the order has been placed by the customer, the latter will be informed by VINS ET VIGNOBLES FAYARD by e-mail of the delivery of a partial order or the total cancellation of the order.

In accordance with article L. 121-20-3 of the French Consumer Code, the customer may :

- Or be delivered a product of equivalent quality and price, within the limits of available stocks;

- Or to be reimbursed for the price ordered within thirty (30) days of the request.

Article 7 - Delivery

7.1. Place of delivery

Products are sent to the address indicated by the customer when placing an order on the www.chateausaintemarguerite.com website.

The place of delivery can only be in Metropolitan France and Corsica.

If the delivery address proves to be incorrect due to the customer's fault, the products will be returned to VINS ET VIGNOBLES FAYARD without any request for reimbursement from the customer being accepted by VINS ET VIGNOBLES FAYARD.

7.2. Delivery method

Delivery will be made by a carrier whose contact details will be sent to the customer in the order confirmation e-mail.

Deliveries are made from Monday to Friday.

7.3. Delivery time

Delivery times are between two (2) and seven (7) working days from payment of the order.

In the event that the customer orders different products for which different delivery times apply, the longest delivery time will be used, without exceeding thirty (30) days from the product order date, in accordance with the French Consumer Code.

7.4. Late delivery or non-delivery

In such a case, the customer may contact VINS ET VIGNOBLES FAYARD by e-mail: contact@vinsfayard.com or by telephone on 04.94.00.44.44 from Monday to Friday, 9am to 12pm and 2pm to 6pm.

The customer may cancel the order if the product has not been delivered within seven (7) working days of the scheduled delivery date.

This possibility does not apply in the event of force majeure as defined by French case law.

7.5. Delivery made

All deliveries are presumed to have been made when the parcel is made available to the customer, as evidenced by the signature on the delivery note.

The customer must indicate any reservations he deems necessary directly to the carrier at the time of delivery. Failing this, the customer has a period of three days from receipt of the order in which to make any claims by registered letter with acknowledgement of receipt addressed to the carrier, a copy of which is also addressed to VINS ET VIGNOBLES FAYARD.

Article 8 - Product conformity

In the event of non-conformity of the product, the customer may return it to VINS ET VIGNOBLES FAYARD.

The customer may ask VINS ET VIGNOBLES FAYARD :

- Or be delivered a product identical to that ordered within the limits of available stocks;

- Or be delivered a product of equivalent quality and price within the limits of available stock;

- Or to be reimbursed for the price of the product ordered within thirty (30) days of the customer's request.

VINS ET VIGNOBLES FAYARD will bear the cost of returning the product, as well as any delivery of another product.

The product(s) must be returned in their original packaging to the following address:

 Article 9 - Warranties

Products marketed by VINS ET VIGNOBLES FAYARD are covered by the legal warranty.

Article L211-4 of the French Consumer Code

"The seller is obliged to deliver goods in conformity with the contract and is liable for any lack of conformity at the time of delivery.

He shall also be liable for any lack of conformity resulting from the packaging, assembly instructions or installation when the latter is his responsibility under the contract or has been carried out under his responsibility.

Article L211-5 of the French Consumer Code

"To conform to the contract, the good must :

1° Be fit for the use ordinarily expected of similar goods and, where applicable :

- correspond to the description given by the seller and possess the qualities that the seller has presented to the buyer in the form of a sample or model;

- have the qualities that a purchaser may legitimately expect in the light of public statements made by the seller, the producer or his representative, particularly in advertising or labelling;

2° Or have the characteristics defined by mutual agreement between the parties or be suitable for any special use sought by the buyer, brought to the seller's attention and accepted by the latter.

Article L211-12 of the French Consumer Code

"Action resulting from a lack of conformity is barred after two years from delivery of the goods.

Article 1641 of the French Civil Code

"The seller is liable for any hidden defects in the item sold which render it unfit for its intended use, or which impair that use to such an extent that the buyer would not have purchased it, or would have paid a lower price for it, had he been aware of them.

Article 1648 paragraph 1 of the French Civil Code

"The action resulting from redhibitory defects must be brought by the purchaser within two years of the discovery of the defect.

VINS ET VIGNOBLES FAYARD undertakes either to reimburse the customer for the product or to exchange the product for an identical product depending on available stocks in the event of delivery of a product revealing a defect.

For any request, the customer must contact VINS ET VIGNOBLES FAYARD by e-mail: contact@vinsfayard.com or by post at the following address: 381 route de Valcros - 83250 LA LONDE LES MAURES, stating the reasons for the request, and must leave the product(s) at VINS ET VIGNOBLES FAYARD's disposal for appraisal.

Warranty exclusions :

The warranty does not cover products that have been modified or tampered with by the customer.

The warranty does not apply to apparent defects. Similarly, the warranty does not apply to products damaged in transit, or in the event of misuse, storage, negligence or lack of maintenance, normal wear and tear or force majeure.

The warranty is also excluded if the customer has not complied with the following storage conditions:

- In a cellar at a temperature of between 10°C and 13°C (average temperature over the year 13°C);

- With humidity levels between 70% and 80% ;

- Store away from light and foreign odors;

- Bottles must be laid

Article 10 - Right of withdrawal

10.1. Right of withdrawal

In accordance with the provisions of Articles L. 121-20 et seq. of the French Consumer Code, the customer has a right of withdrawal of seven (7) clear days from receipt of the product without having to justify his reasons.

If the time limit expires on a Saturday, Sunday or public holiday, it is extended to the next working day.

As an exception, and in accordance with article L.121-20-3 of the French Consumer Code, the right of withdrawal does not apply to bottles opened for consumption and/or tasting.

10.2. Exercise and conditions of return of products

The customer must return the products in their original packaging and in good condition to the head office of VINS ET VIGNOBLES FAYARD 381 Route de Valcros - 83250 LA LONDE LES MAURES.

10.3. Repayment

If the customer exercises his/her right of withdrawal, VINS ET VIGNOBLES FAYARD will reimburse the customer within thirty (30) days of the product being sent by the customer.

The customer will be reimbursed for the price actually paid, with the exception of return costs, which remain at the customer's expense.

 Article 11 - Intellectual property

VINS ET VIGNOBLES FAYARD is the owner of all copyrights pertaining to its Internet site as a whole, as well as to each element, in particular the graphic charter, editorial content, photographs and software.

VINS ET VIGNOBLES FAYARD is the owner of the French brand FAMILLE FAYARD- VINS EN PROVENCE as well as Château Sainte Marguerite.

Any partial or total reproduction of the contents of the Internet site and/or the FAMILLE FAYARD- VINS EN PROVENCE and Château Sainte Marguerite brand without the prior written authorization of VINS ET VIGNOBLES FAYARD constitutes an infringement liable to result in legal proceedings.

Use of the website and orders placed on the site do not confer any intellectual property rights on the content of the site or on the FAMILLE FAYARD- VINS EN PROVENCE brand or the Château Sainte Marguerite brand.

Article 12 - Reservation of title

The transfer of ownership of the product sold to the customer is delayed until full and complete payment of the price to VINS ET VIGNOBLES FAYARD.

The risks relating to the product sold are borne by the customer from the time of delivery.

Article 13 - Personal data

To place an order on the www.chateausaintemarguerite.com website, the customer must fill in a form showing the fields that must be completed.

This information constitutes personal data. It is recorded and kept by VINS ET VIGNOBLES FAYARD. VINS ET VIGNOBLES FAYARD undertakes to respect the confidentiality of personal data provided by the customer.

The personal data collected by VINS ET VIGNOBLES FAYARD, such as surname, first name, postal address, e-mail address and telephone number, is required to manage the order, invoicing, delivery and possibly promotional e-mails if the customer has agreed to receive them.
